Terms and Conditions for IronCrest Recovery
Welcome to IronCrest Recovery. These Terms and Conditions govern your use of our vehicle recovery and roadside assistance services. By requesting or using any service offered by IronCrest Recovery, you agree to be bound by these Terms and Conditions. Please read them carefully.
1. Definitions
- "IronCrest Recovery", "we", "us", or "our" refers to IronCrest Recovery, a vehicle recovery and roadside assistance provider.
- "Client", "you", or "your" refers to the individual or entity requesting or using our services.
- "Services" refers to all services provided by IronCrest Recovery, including but not limited to emergency car towing, vehicle winching, roadside repairs, accident recovery, long-distance towing, and secure vehicle storage.
- "Vehicle" refers to the motor vehicle that is the subject of the requested service.
2. Service Request and Acceptance
All service requests are subject to availability and the operational capacity of IronCrest Recovery. We reserve the right to decline any service request at our sole discretion, including but not limited to situations where the service location is deemed unsafe, the vehicle is unaccessible, or the requested service is beyond our operational capabilities. By requesting a service, you confirm that you are the owner of the vehicle or have the express permission of the owner to authorise the service.
3. Pricing and Payment
- Prices for our services will be communicated to you prior to the commencement of work. Any additional services or unexpected complexities encountered during the service may incur extra charges, which will be communicated and agreed upon before proceeding.
- Payment is due in full upon completion of the service. We accept various payment methods, which will be advised at the time of service.
- Failure to make timely payment may result in additional charges, including but not limited to late payment fees and collection costs. We reserve the right to retain possession of your vehicle until full payment is received.
4. Client Responsibilities
- You must accurately describe the vehicle's condition, location, and the nature of assistance required when making a service request.
- You are responsible for ensuring the safety of yourself and other occupants at the service location, especially on public roads or hazardous environments, before our team arrives.
- You must provide all necessary documentation requested by IronCrest Recovery, including proof of ownership and identification, prior to or upon arrival for service.
- You are responsible for removing all valuables and personal belongings from the vehicle before towing or storage. IronCrest Recovery accepts no liability for loss or damage to such items.
5. Limitations of Liability
- IronCrest Recovery will perform all services with reasonable care and skill. However, we are not liable for pre-existing damage to the vehicle that was not caused by our actions during the service.
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from your use or inability to use our services.
- Our total liability for any claim arising out of or in connection with these Terms or the services provided shall not exceed the amount paid by you for the specific service giving rise to the claim.
- IronCrest Recovery is not responsible for any delays or failures in service caused by circumstances beyond our reasonable control, including but not limited to severe weather, road closures, traffic accidents, or government actions.
6. Vehicle Storage
- If your vehicle is stored at our facility, daily storage fees will apply. These fees will be communicated to you at the time of storage.
- Vehicles must be collected within the agreed timeframe. Unclaimed vehicles or vehicles for which storage fees remain unpaid may be subject to a lien and eventual disposal in accordance with applicable laws.
- While we take reasonable precautions, IronCrest Recovery is not responsible for damage to or theft of vehicles in storage that is not a direct result of our gross negligence.
7. Cancellations and Refunds
- If you cancel a service request after our recovery vehicle has been dispatched, a call-out fee may be charged to cover our costs and time. The exact fee will depend on the distance travelled and time elapsed.
- Refunds will be issued at the discretion of IronCrest Recovery, typically only in cases where we fail to provide the agreed service due to our fault.
8. Indemnification
You agree to indemnify and hold harmless IronCrest Recovery, its officers, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your breach of these Terms and Conditions or your misuse of our services.
9. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
10. Amendments to Terms
IronCrest Recovery reserves the right to update or modify these Terms and Conditions at any time. Any changes will be posted on our online platform, and your continued use of our services after such changes constitutes your acceptance of the new Terms and Conditions.
